The work traces the history of palliative care starting from the hospice movement of Cecily Saunders to the recognition by the World Health Organization, by the institutions of the Council of Europe and, in Italy, to the approval of the law 38 of 2010. The work analyzes, in particular, the recent resolution 2249/2018 by the Parliamentary Assembly of the Council of Europe, also in relation to two recent documents presented to the Italian Parliament: the Government's report on the state of implementation of law 38 of 2010, published the 31th of January 2019, and the conclusions, produced the 10th of April 2019, of the inquiry conducted by the Social Affairs Commission of the Chamber of Deputies on the development of palliative care, especially pediatric care, in Italy. The law 219 of 2017 and the ordinance 207 of 2018 of the Constitutional Court are then analyzed to assess the possible repercussions on the right to palliative care and pain therapy. Finally, the issue of the distinction between palliative care and euthanasia and that of the possible coexistence between one and the other option within the same legal system is also addressed, also through the consideration of comparative experience.
Il contributo ripercorre la storia delle cure palliative a partire dall’hospice movement di Cecily Saunders, fino al riconoscimento da parte della World Health Organization e delle istituzioni del Consiglio d’Europa e, in Italia, fino all’approvazione della legge 38 del 2010. Si esamina, in particolare, la recente risoluzione 2249/2018 dell’Assemblea parlamentare del Consiglio d’Europa, anche in relazione a due recenti documenti presentati al Parlamento italiano: il rapporto del Governo sullo stato di attuazione della legge 38 del 2010, del 31 gennaio 2019, e le conclusioni, presentate il 10 aprile 2019, dell’indagine conoscitiva condotta dalla Commissione Affari Sociali della Camera dei Deputati sullo sviluppo delle cure palliative, specialmente pediatriche, in Italia. Si analizzano poi la legge 219 del 2017 e l’ordinanza 207 del 2018 della Corte costituzionale per valutarne le possibili ripercussioni sul diritto alle cure palliative e alla terapia del dolore. Si affronta, infine, il tema della distinzione fra le cure palliative e l’eutanasia e quello, ulteriore, della eventuale convivenza fra l’una e l’altra opzione all’interno del medesimo ordinamento, anche attraverso la considerazione dell’esperienza comparata.
