In a European market, which since many years has become “internal”, the fiscal factor plays a decisive role for the competitiveness of the economic and productive systems of the Member States, which, however, are no longer completely free to conduct their tax policies. In fact, if the division of powers between Member States and the European Union is, in this field, distinct, however in practice there are significant “incursions” on national allocations, even those that can be qualified as exclusive. More specifically, in the fiscal area, the autonomy of the national legislator encounters a double limitation deriving, on the one hand, from the strict application of the principle of non-discrimination and, on the other hand, from the inflexible application of State aid discipline. The volume analyses these complex relations and, in particular, refers to the mechanisms of harmonization and approximation of the tax laws so far introduced. Furthermore, the application of the principle of non-discrimination is analytically described, in its various forms. Ample space is also dedicated to the impact produced by State aid regulation on national tax systems and, in this context, particular attention is paid to: the analysis of the methods for the recovery of State credits, the system of tax ruling, the evaluation of transfer pricing, the Advance Pricing Agreements. In the aforementioned sectors, in fact, the Commission has recently adopted a series of Decisions (Apple, Starbucks, Fiat Finance and Trade) which pose delicate legal questions and that have been challenged before the General Court.
In un mercato europeo, divenuto ormai “interno” da molti anni, il fattore fiscale assume un ruolo determinante per la competitività dei sistemi economici e produttivi degli Stati membri i quali, tuttavia, non sono più completamente liberi nel condurre le proprie politiche tributarie. In effetti, se il riparto delle competenze tra Stati membri e Unione europea è, in questa materia, netto, nella pratica si registrano delle significative “incursioni” sulle attribuzioni nazionali, anche quelle qualificabili come esclusive. Più specificatamente, in materia fiscale, l’autonomia del legislatore nazionale trova una doppia limitazione che gli deriva da un lato, dalla rigida applicazione del principio di non discriminazione e, dall’altro, dall’inflessibile applicazione della disciplina degli aiuti di Stato. Nel volume vengono approfondite tali complesse relazioni ed, in particolare, viene fatto cenno ai meccanismi di armonizzazione e di ravvicinamento delle legislazioni fiscali sinora introdotti e quindi viene analiticamente descritta l’applicazione del principio di non discriminazione, nelle sue diverse declinazioni. Ampio spazio viene inoltre dedicato all’impatto prodotto dalla disciplina degli aiuti di Stato sui sistemi fiscali nazionali ed, in questo contesto viene dedicata particolare attenzione all’analisi delle modalità di riscossione dei crediti vantati dallo Stato nei confronti delle imprese, al sistema degli interpelli (o tax ruling), dei prezzi di trasferimento (transfer pricing) e degli accordi preventivi in materia di prezzi di trasferimento (Advance Price Agreements). Nei richiamati settori, infatti, la Commissione ha recentemente adottato una serie di Decisioni (la Apple, Starbucks, Fiat Finance and Trade) che pongono dei delicati problemi giuridici e che sono state contestate davanti al Tribunale UE.
