From the analysis of the problems that art. 587 c.c. Resolved, new problems are identified: if non-patrimonial arrangements can be made beyond the cases provided for by law; Whether non-patrimonial provisions are testamentary. Through the analysis of c.d. problems Atypical content of the testament proves that in our order the will is not the only act of ultimate will and that it is not to be expressed only with heir and legacy institutions. It is therefore proposed to rethink the act of last will, which, as an act of impulse through which the dignity of the person is realized, is susceptible, with the limit of the heirs and legate institutions, of all Content that is legitimate and deserving.

Dall’analisi dei problemi che l’art. 587 c.c. ha risolto, si individuano i nuovi problemi: se si possano dare disposizioni non patrimoniali oltre i casi previsti dalla legge; se disposizioni non patrimoniali abbiano natura testamentaria. Attraverso l’analisi dei problemi sul c.d. contenuto atipico del testamento si dimostra che nel nostro ordinamento il testamento non è l’unico atto di ultima volontà e che non si deve esprimere soltanto con istituzioni di erede e legati. Si propone, quindi, un ripensamento dell’atto di ultima volontà, il quale, in quanto atto d’impulso attraverso il quale si realizza la dignità della persona, è suscettibile, con il limite delle istituzioni di erede e dei legati, di tutti i contenuti che risultino leciti e meritevoli.
