Di un ‘pensiero rivelativo’: l’ontofenomenologia giuridica di Sergio Cotta

The figure and work of Sergio Cotta require a rethinking of philosophical reflection about the phenomenon coexistential of legality, from a thought which proposes the 'off' onto-phenomenological law. How Pareyson clarifies: "" The thought is always revelatory set of expression, because the truth is not offered unless within each single perspective: the truth is accessible only through a personal relationship and irreplaceable formulated only through personal way d ' access to it. La figura e l'opera di Sergio Cotta esigono un ripensamento della riflessione filosofica intorno al fenomeno coesistenziale della giuridicità, a partire da un pensiero che propone la 'via' onto-fenomenologica al diritto. Il riferimento principale è ad un pensiero rivelativo, capace di cogliere, oltre il mutevole e storico darsi delle formulazioni normative, il nucleo fenomenologico di un momento dell'essere sociale, forse il momento più rilevante della pluralità coesistita dell'essere, cioè il fenomeno della giuridicità, il diritto da intendere nella sua dimensione ontologica. In questa direzione, si è situati in un ordine per cui risulta possibile esperire la verità del dato giuridico, rivelandone l'appartenenza originaria al fenomeno diritto, attraverso la principalità del pensiero rivelativo. Come chiarisce Pareyson: "Il pensiero rivelativo è sempre insieme espressivo, perché la verità non si offre se non all'interno d'ogni singola prospettiva: la verità è accessibile solo mediante un insostituibile rapporto personale e formulabile solo attraverso la personale via d'accesso ad essa. Il pensiero che muove da questa solidarietà originaria di persona e verità è al tempo stesso ontologico e personale, e quindi insieme rivelativo ed espressivo, cioè esprime la persona nell'atto di rivelare la verità e rivela la verità nella misura in cui esprime la persona, senza che l'uno dei due aspetti prevalga sull'altro".
