The Book XXVI of the “Esprit des lois” on the relation between laws and order of things, generated many discussions about his real significance inside the Montesquieu’s work: an useless one, as Destutt de Tracy said, or the hidden conclusion of the “Esprit des lois”, as Paul Vernière suggested? Through the analysis of the chapters of the book, this paper points out Montesquieu’s reflections on basic notions, such as nature and culture, private and public, politics and religion. The establishing by Montesquieu of clear relations between different codes of laws (divine, natural, human) is consistent with his liberalism.
Il libro XXVI dell'Esprit des lois sulla relazione tra leggi e ordine delle cose ha generato molte discussioni sul suoreale significato all'interno dell'opera di Montesquieu: un libro inutile, come disse Destutt de Tracy, o la vera conclusione dell'Esprit des lois come suggerì Paul Vernière? Attraverso l'analisi dei capitoli del libro, questo saggio colloca la riflessione di Montesquieu sullo sfondo di nozioni fondamentali come natura e cultura, privato epubblico, politica e religione. La sistemazione fattada Montesquieu delle relazioni tra codici differenti (divino, naturale, umano) è coerente col liberalismo dell'autore.
