Through the analysis of a corpus of judgments, consilia et quaestiones produced in Italian cities the article aims at clarifying the reasons which explain th relatively soft attitude that lawyers of the thirteenth century manifested against men accused of political crimes. To accomplish such task, it examines the political ban from its first appearance in municipal law (second half of the twelfth century), through the big exclusions of late thirteenth century, until the beginning of next century when political exclusion wad promoted by the ordinary courts. Finally, to show the close connection between practice and theory, the article analyzes a political process held in 1294 in Bologna before Alberto Gandino, the author of a famous tractatus criminum then judge at the captain of the peoples’ curia.
Attraverso l'analisi di un dossier di sentenze, consilia et quaestiones di produzione comunale l'articolo tenta di chiarire le ragioni dell'atteggiamento relativamente morbido che i giuristi del XIII secolo manifestarono nei confronti degli autori di reati politici. A questo fine si prende in esame il bando politico dalla sua prima apparizione nell'Italia comunale (seconda metà del secolo XII) alla vigilia delle grandi esclusioni tardoduecentesche (anni 1250). Si osserva quindi il periodo delle grandi esclusioni (dagli anni Sessanta del Duecento alla fine del secolo) prima dal punto di vista della pratica giudiziaria, poi da quello della giurisprudenza. Infine, per mostrare la stretta interconnessione tra pratiche e teorie, si analizza un processo politico inedito tenutosi nel 1294 a Bologna dinnanzi ad Alberto Gandino, allora giudice presso la curia del capitano del popolo.
