The paper provides a critical reading of the judgment of the Court of Justice of the European Union in case C-258/16, in which the interpreter of European law analyzed the requirements of time and form of the complaint referred to in art. 31 of the 1999 Montreal Convention on international air transport. It is known that the latter differs from the Property Irregularity Report (PIR) and must be presented by the passenger when the checked baggage is damaged to avoid the extinction of the action against the carrier.

Il lavoro opera una lettura critica della decisione resa dalla Corte di giustizia UE nella causa C-258/16, nella quale l’interprete del diritto europeo ha analizzato i requisiti di tempo e di forma del reclamo, l’atto, che l’art. 31 della Convenzione di Montreal del 1999 sul trasporto aereo internazionale, prescrive debba essere presentato, in caso di danno al bagaglio consegnato, dal passeggero al vettore per evitare l’estinzione delle azioni contro quest’ultimo.
